Terms of use

This is a courtesy translation. The German Nutzungsbedingungen are the binding version.

These terms apply to the use of pols.so, in particular the sandboxes, the API and the account pages at my.pols.so (the “Service”).

1. Provider

2. Service

pols.so provides isolated sandboxes that you can create, use and delete through the API, the command line and my.pols.so. Scope and quotas follow from your account. We develop the Service continuously and may change features as long as the core of the Service is preserved.

3. Access

You get an account by signing up with an email address. Access is by invitation or after our approval; there is no right to approval. Keep your API keys and login links secret; you are responsible for actions taken through your account.

4. Permitted use

In particular, the following is prohibited:

• mining cryptocurrencies;
• sending spam or unsolicited messages;
• scanning, attacking or intruding without authorization into third-party systems and networks, and denial-of-service attacks;
• storing, distributing or retrieving illegal content, and any other unlawful use;
• circumventing quotas, limits or protective measures of the Service.

To protect the Service, we monitor the load and network traffic of the sandboxes automatically. If we suspect a violation, we may stop or delete sandboxes, revoke API keys and suspend accounts, with prior notice where possible.

5. Availability

We strive for reliable operation but do not guarantee any particular availability (no SLA). Maintenance, outages and changes may limit the Service temporarily.

6. Data and deletion

Content in your sandboxes remains yours. Sandboxes are not meant as permanent storage; back up important data yourself. When you delete a sandbox or your account, the associated data is deleted and cannot be restored. How we process personal data is described in the privacy policy.

7. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under mandatory statutory provisions. For slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded, in particular for data loss to the extent it could have been avoided by your own backups.

8. Term and termination

The contract runs for an indefinite period. You can terminate it at any time by asking for the deletion of your account by email. We can terminate with 30 days' notice; the right to terminate without notice for good cause, in particular for violations of section 4, remains unaffected.

9. Changes

We will notify you of changes to these terms by email at least 30 days in advance. If you do not object before they take effect, they are deemed accepted; we will point this out in the notification.

10. Law and jurisdiction

The law of the Grand Duchy of Luxembourg applies. Mandatory consumer protection provisions of your country of residence remain unaffected. The place of jurisdiction for merchants is Luxembourg. Should any provision be invalid, the remaining provisions remain valid.
